Restricts participation on sports teams to members of the same biological sex, except for teams specifically designated as co-ed. This will protect girls from physical injury and loss of opportunity by bigger and stronger boys.

Under Prop 134, participation in K-12 school sports would be "determined by certain aspects of their biological reproductive system". Any language that suggests a genital examination of school children is wildly inappropriate.

School sports is an important part of the educational experience. Proposition 134 would require gender checks for student athletes so that they participate only in sports that match the sex they were assigned at birth. However, there are very few transgender athletes. We recommend voting NO on this proposition. - Prop 134 conflicts with an existing Colorado law that protects students’ right to participate safely and fairly. - Prop 134 prevents parents, schools, and athletic associations from deciding how students participate in sports. - Prop 134 puts athletes at risk of gender-checks based on how they “look.” As a parent, do you want your children “inspected” before they play a sport? - Prop 134 creates an invasive law to control the very few transgender students who play sports but that could be applied to all athletes. Schools, school districts, and athletic groups should continue to set their own policies in alignment with laws we already have. Students should be free to enjoy playing sports without fear of someone questioning who they are.

We encourage voters to vote NO on Proposition 134. We do not support measures that seek to stigmatize or isolate children, and this measure is poorly written and poorly thought through as there is no plan for determination of a student’s sex, leaving the door open to coaches or other school administrative figures checking children’s genitalia which is inappropriate and wrong.

Passes with a majority vote.
Shall there be a change to the Colorado Revised Statutes creating new law restricting participation in all K-12 and collegiate school sports based on the participant’s sex as determined by certain aspects of their biological reproductive system, and, in connection therewith, requiring a school, institution of higher education, or athletic association to designate each school or intramural athletic team or sport as male, female, or coeducational; only allowing participants to compete on the team or sport of their designated sex or to compete on a coeducational team; creating an exception to allow a female to participate on a male-designated team or sport if there is no female team available; prohibiting a government entity, licensing or accrediting organization, or athletic association from entertaining a complaint, opening an investigation, or taking other adverse action against a school for maintaining separate teams or sports for females; and providing the commissioner of education with the authority to enforce the proposed initiative for K-12 school districts?
Proposition 134 addresses participation in school and collegiate sports and establishes statutory definitions and team-designation requirements based on sex.
Why Vote YES?
Girls deserve a fair opportunity to compete in athletic programs.
Sex differences can matter in competitive athletics, particularly in sports involving strength, speed and physical performance.
The purpose of school sports is to provide students with fair competition, educational opportunities and a chance to develop discipline and teamwork.
Protecting female athletic opportunities does not require hostility toward anyone. It requires establishing clear rules that preserve competitive fairness.
Position: Maintain fair competition and protect opportunities for female athletes. Vote YES.
