Who is liable when an AI decides to do something bad that humans didn't intend?
AI is the first technology in history that can make decisions on its own. We should hold the AI companies responsible by assigning intent to the AI.
Specifically: when an AI autonomously chooses an illegal action in pursuit of an objective, the law should always treat that action as intentional, and hold the AI companies responsible for the consequences as if they did it intentionally.
To put it simply: If you direct your AI to do something bad, you’re guilty; whereas if the AI does something bad on its own, the AI companies are guilty.
Redirect the AI race to focus on safety.
The prospect of massive liabilities or prison time would change incentives for tech companies and investors to prioritize making AI that abides by laws. Let the safest AI win.
Intentional crimes have the highest penalties. The legal term is mens rea, or a “guilty mind,” as immortalized by Elle Woods in Legally Blonde.
Can AI have a guilty mind? That's besides the point. When AI decides to commit an illegal act on its own, hold the AI companies liable as if they did it intentionally.
