No on Prop 5: Weakens Citizens’ Right to Recall Politicians from Office
Makes it harder to Recall a politician from office and simultaneously replace them with a candidate of the voters’ choosing. Under Prop 5, if the voters recall the Governor, you don’t get to choose the replacement — the office is automatically handed to the political machine’s second-in-command. The decision will be entirely out of the voters’ control.

NO on Prop. 5
This measure alters the constitutional right to recall a state officer and vote for a replacement candidate. Proposition 5 would eliminate the election of a replacement candidate in recalls of statewide officeholders and state legislators. Offices would be filled by appointment or later special election. If a governor was recalled, the Lieutenant Governor would become Governor for the remainder of the unexpired term or until a special election, depending on timing. Proposition 5 allows the recalled officeholder to run in the special election to fill the seat, which current law prohibits. This measure makes a mockery of the recall process.
Vote NO on 5.

Prop. 5 would change the current law regarding recall elections for state officials. Current law asks voters two questions: (a) should the official be recalled and (b) if so, who is the replacement. As described by the League of Women Voters, one the Prop. 5’s sponsors: “These two questions together create a dangerous loophole. An elected official can be removed by a narrow majority. Then, a candidate listed in question #2 can win the office with far less than 50% of the votes cast in the election. This encourages political actors to target officials they couldn’t defeat in a regular election and to install replacements who lack broad public support.”
Prop. 5 would separate those two questions, so that the recall election decides only whether the official is recalled. If the Governor is recalled, the Lt. Governor will fill the office until the end of the term unless the recall is before the nomination period closes for the next statewide election in the Governor’s first two years. If so, a candidate winning more than 50% of the vote in a primary becomes governor, otherwise the winner of a runoff between the top two vote-getters in the general election becomes Governor. This ensures that a replacement Governor has broad popular support and may deter political game-playing. I will vote “yes.”
